Clear terms for giving every sale its encore.
These terms are an agreement between AuditPatterns, LLC and the merchant using EncorePop. By installing or using the service, a merchant agrees to these terms on behalf of the business operating the connected Shopify store.

EncorePop turns eligible activity from a connected Shopify store into configurable storefront notifications. Features can include recent purchases, exact purchase roundups, consent-aware live visitor activity, campaign controls, and reporting. Features may change as the product develops.
Eligibility and accounts
You must be authorized to act for the connected Shopify merchant and provide accurate account information. You are responsible for protecting access to the Shopify account and for activity performed through authorized users.
Merchant responsibilities
- Use EncorePop only with stores, orders, products, and themes you are authorized to manage.
- Configure notifications and optional customer fields in accordance with applicable law and your published privacy disclosures.
- Do not attempt to fabricate activity, bypass plan limits, interfere with the service, reverse engineer restricted components, or use EncorePop for unlawful or deceptive purposes.
- Review storefront output and disable a campaign if it is unsuitable for your store or customers.
Plans and billing
Free and paid plan limits are described on the pricing page and inside the app. Paid subscriptions are approved, billed, managed, and cancelled through Shopify App Pricing. EncorePop does not automatically move a merchant to a higher paid plan when a usage limit is reached. Applicable taxes, Shopify billing rules, and displayed renewal terms apply.
Customer data and privacy
Each party is responsible for its obligations under applicable privacy and data protection law. EncorePop processes merchant and shopper information as described in the Privacy Policy and in accordance with the merchant’s settings and Shopify’s required privacy workflows.
Ownership and feedback
Merchants retain their rights in store content and data. EncorePop retains its rights in the service, software, brand, documentation, and product materials. If you provide feedback, you permit us to use it to improve the service without identifying you publicly unless you separately approve that use.
Availability, suspension, and termination
We work to keep EncorePop available but do not promise uninterrupted operation. We may suspend access to protect stores, shoppers, Shopify, or the service; respond to legal requirements; address nonpayment; or stop misuse. Merchants may stop using the service by unpublishing campaigns, disabling the theme app embed, cancelling a paid subscription through Shopify, or uninstalling the app.
Disclaimers and liability
EncorePop is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee increased sales, conversion rates, revenue, or any other business result. To the extent permitted by law, EncorePop is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service. Rights that cannot legally be limited remain unaffected.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that is not subject to a different legally required forum will be brought in a court with jurisdiction over Moorpark, California, and each party consents to that venue.
